Terms and Conditions
I acknowledge that I have read and agree to the following Terms and Conditions of this purchase by signifying my consent in the box below. These Terms and Conditions form the basis of this Agreement of Purchase and Sale
Processing My Order:
I understand that processing time of my purchase may vary by product. Products that are in stock will be shipped the same day as my order provided they are entered before shipping cutoff time of 11:00 am EST. Orders entered after 11:00 am EST will be processed and shipped the following business day. Orders for products that are not in stock will be processed and shipped in a timely manner. Orders that cannot be fulfilled within 30 days are subject to cancellation.
Payment, Pricing, Promotions & Delivery:
All online sales will be paid for by valid credit card issued in the name of the purchaser together with proper 3-digit security code and expiry date.
My credit card will be authorized for the amount charged at the time the order is placed. Once the product is shipped my credit card will be invoiced. An invoice will be sent to my e-mail address provided by me at the time of my order. I acknowledge that false information or use of an invalid credit card may amount to credit card fraud on my part.
I acknowledge and understand that if my order cannot be fulfilled within 30 days that my order is subject to cancellation with the exception to sauna kits and pre-built saunas.I acknowledge and understand that because sauna kits and pre-built saunas are custom manufactured orders that take an excess of 30 days to manufacture that my credit card will be authorized and invoiced the moment the manufacturing has begun on my sauna kit or pre-built sauna.
I acknowledge that larger items such as pre-built saunas, sauna kit, woodburners, and commercial sauna heaters ship by common carrier. My order will be delivered to my driveway packaged on a palette which can be opened and the packaged contents can be unloaded separately by hand with some items requiring two people. I agree that lift gate truck service is available at an optional charge.
I understand that every item shipped is inspected and carefully packaged to arrive safely. Most shipments arrive on time and without issue. Although rare, damage in transit can occur. I agree to carefully inspect all items upon arrival and note on the Bill of Lading (Delivery Receipt) any damaged/missing products.
Upon delivery of the product(s), I agree to immediately inspect the packaging of the product(s) and notify the delivery company immediately of any damage of the packaging should damage upon transit occur.
My receipt of the product(s) includes an acknowledgement by me that I have inspected the product and an acknowledgement by me that the product was received by me in pristine condition and ready for installation. Any claim, after receipt of the product(s), that the product(s) is/are unsatisfactory must relate to the mechanical workings of the product(s) not its appearance or condition upon receipt or damage by the process of installation.
I acknowledges that it is my responsibility to have all electrical components installed only by a certified, licensed electrician. Failure to do so will mean that any damage caused to electrical and or components will not be the responsibility of the Seller.
I acknowledge that my agreement to the Terms and Conditions of my purchase of the Seller’s product(s) is admissible against me and in favor of the Seller in the event of any later legal claim by me alleging a deficiency in the product(s), or, application by me for a credit card chargeback, or, any other administrative complaint made by me to the detriment of the Seller.
With the exception of Custom Cut Sauna Kits and Pre-Built Saunas purchase items may be returned within 10 days of receipt. The date of receipt will be the date when specified shipping service acknowledges the product has been delivered. I acknowledge and understand that Sauna Kits and Pre-Built Saunas cannot returned.
I acknowledge that all returns will be charged a fee equivalent to 20% of the value of the product(s) returned at the time of sale as a re-stocking fee. I acknowledge that my shipping costs are non-refundable.
I agree that if I decide to return any product(s) that I will immediately notify the trained staff of the Seller by telephone at 866.918.9941. The trained staff will assist me in complying with the terms of this Return Policy.
I understand and accept that for any valid return of product(s) that I must obtain from the Seller a Return Merchandise Authorization number (“RMA”) in order to make a valid return. Failure to do so will result in forfeiture of the full amount of the sale to the Seller whether or not product(s) are actually returned to the Seller.
I understand that obtaining an RMA ensures that the product(s) for return are properly labeled and properly packaged to prevent damage to product(s) in the return process.
Limitation of Liability:
I agree that in no case shall 123 Saunas, American Health Inc, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from my use of any of the service or any products procured using the service, or for any other claim related in any way to my use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.
I agree to indemnify, defend and hold harmless 123 Saunas, American Health Inc, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including attorneys’ fees, made by any third-party due to or arising out of my breach of these Terms and Conditions or the documents they incorporate by reference, or any violation of any law or the rights of a third-party. I understand that my order will appear on my credit card statement as a payment to American Health Inc. whose head office is located in Panama City, Panama, one of the world’s major centers of international commerce and trade.
